These Terms of Service ("Terms") govern your use of OpiniPop, operated by Sightific LLC ("we," "us," or "OpiniPop"). By creating an account or using the service you agree to these Terms. If you do not agree, do not use OpiniPop.
You must meet all of the following requirements to use OpiniPop:
We reserve the right to verify eligibility at any time and to suspend or close accounts that do not meet these requirements. Rewards earned by ineligible users are void and will not be paid out.
You must provide accurate, current, and complete information when creating your account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You may not:
Only one account per device may earn rewards or request cashouts. Notify us immediately at support@opinipop.com if you believe your account has been compromised.
Violation of these rules may result in immediate account suspension, forfeiture of all rewards, and a permanent ban.
By participating in surveys you agree to answer all questions honestly, not select answers randomly or in bad faith, and not use external sources to answer questions unless explicitly permitted. We use automated quality checks to detect low-quality responses. Rewards may be reversed for failed quality review, and repeated failures may result in account suspension.
By us: We may suspend or permanently close your account at any time for any violation of these Terms, suspected fraud, inactivity, or for any other reason at our sole discretion. If we close your account for cause, any unredeemed balance is forfeited.
By you: You may delete your account at any time through Settings or by contacting support@opinipop.com. Any unredeemed balance at the time of voluntary deletion is forfeited.
All content, features, and functionality of OpiniPop are owned by Sightific LLC and protected by applicable intellectual property laws. By submitting survey responses or poll votes, you grant Sightific LLC a non-exclusive, worldwide, royalty-free license to use that content in aggregated and anonymized form for research and analytics.
OpiniPop is provided "as is" and "as available" without warranties of any kind. We do not warrant that the service will be uninterrupted or error-free, that surveys will be available in any given quantity, or that gift card delivery will occur within any guaranteed timeframe.
To the fullest extent permitted by applicable law, Sightific LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability to you for any claim is limited to the greater of (a) $100 USD or (b) the total amount of rewards you redeemed in the 12 months preceding the claim.
These Terms are governed by applicable United States federal law and, where applicable, state law, without regard to conflict of law principles.
Informal resolution first: Before initiating any formal proceeding, you agree to contact us at support@opinipop.com and give us 30 days to attempt to resolve the dispute informally.
Binding arbitration: If we cannot resolve a dispute informally, you and Sightific LLC agree to resolve it through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which allow for remote hearings. The arbitrator's decision is final and binding.
No class actions: You waive any right to participate in a class action lawsuit or class-wide arbitration against Sightific LLC.
Small claims exception: Either party may bring an individual claim in small claims court as an alternative to arbitration.
We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice in the app at least 14 days before the changes take effect. Continued use after the effective date constitutes acceptance of the updated Terms.
